Clarification on the Rescission of the Fireworks Ban for Unincorporated El Paso County

With the firework ban rescinded, it made the sale and possession of fireworks legal, however we would like to clarify that the use of certain fireworks is still illegal. We are not currently under Stage 1 Fire Restrictions for unincorporated El Paso County. Our county has various topographical features where some terrain may experience large amounts of moisture, but other portions remain dry and may have a higher risk of fire, but at this time does not warrant going into fire restrictions.

The following are still illegal fireworks in El Paso County:

• Bottle rockets
• Mortars
• Roman candles
• Any firework that flies or explodes

Violators may be punished by a fine of up to $750.00, and/or imprisonment for up to six months.

Safety Information:

• If you want to see fireworks, go to a public show put on by experts.
• Keep a close eye on children at events where fireworks are used.
• The risk of fireworks injury is highest for young people ages 15-24, followed by children under 10.
• Nationwide, more than 16,000 reported fires are started by fireworks annually.

The Sheriff, Deputy Fire Warden, the National Weather Service, and other Fire officials will continue to monitor weather and fire danger conditions and may enact additional restrictions as needed in the days and weeks to come.

Should you have any issues with residents using fireworks please call our non-emergency number at (719) 390-5555, and please remember to reserve calling 911 for emergencies only.
