On August 3, 2026, the El Paso County Sheriff’s Office served David Smith with a Notice of Intent to Terminate Employment. On August 12, 2026, Smith was discharged from his position with the El Paso County Sheriff’s Office.
Under Colorado Code of Regulations (4 CCR 901-1, Rule 17), Colorado law enforcement agencies must report certain employment actions involving peace officers to the Colorado Peace Officer Standards and Training (POST) Board.
El Paso County Sheriff Joseph Roybal stated, “The responsibilities entrusted to every Colorado peace officer carry immense authority and an equally great obligation to serve with integrity, professionalism, and accountability. Our community deserves nothing less. When a deputy fails to uphold those standards, I will take appropriate action to ensure accountability and maintain the public’s trust.”
The El Paso County Sheriff’s Office submitted the required notifications to Colorado POST on August 14, 2026.
Deputy Sheriff Arrested on Misdemeanor DUI Charges
On July 21, 2026, Officers at the Colorado Springs Police Department notified the El Paso County Sheriff’s Office an off-duty deputy identified as 41-year-old David Smith had been contacted and charged with Driving Under the Influence, Careless Driving, Accident Driving Under the Influence, and Prohibited Use of Weapons.
Smith has been employed with the Sheriff’s Office since September 2024 and is assigned to the Detention Security Division. He has been placed on Administrative Leave in accordance with policy.
As this is an active investigation, we will not provide further comments regarding this case. All inquiries about the case must be directed to the Colorado Springs Police Department, the investigative agency. However, our Office will update the community on any administrative action taken when appropriate.
